We, Solving Scoliosis Pvt Ltd having its clinic at Pleasant Business Park, Ganeshwadi, Off F.C. Road, Pune 411004 (“we”, “us”, “our” “Company”) are the owners of the mobile-based application ‘Solving Scoliosis’ (the “App”) and website  www.solvingscoliosis.com  (the “Website”). (the “Platform”). The Website and App are collectively referred to as platform (the “Platform”). The Website provides information about Scoliosis and the different types of non-surgical treatment and bracing offered by us for correcting Scoliosis. The App facilitates the Users to take photos and exchange information (including but not limited to photos, videos, X-rays, prescriptions, medical reports, and bills) between the Users and the Company (“Services”).  

We respect data privacy rights and are committed to protecting personal information collected on this Platform. This Privacy Policy (“Privacy Policy”) sets forth how we collect, use and protect the personal information collected on the Platform.

IF YOU ARE ACCESSING THE PLATFORM ON BEHALF OF A THIRD PARTY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH THIRD-PARTY TO THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY AND, IN SUCH AN EVENT YOUR USE OF THE PLATFORM SHALL REFER TO USE BY SUCH THIRD PARTY. IF YOU DO NOT HAVE SUCH AN AUTHORITY (TO PROVIDE ANY PERSONAL INFORMATION OF A THIRD PARTY) OR DO NOT AGREE TO THE TERMS OF THIS PRIVACY POLICY, THEN YOU SHOULD REFRAIN FROM USING THE PLATFORM.

This Privacy Policy is an electronic record in the form of an electronic contract being compliant and construed in accordance with The Indian Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 under The Information Technology Act 2000 (“Privacy Rules”) that require publishing of Privacy Policy for the collection, use, storage and transfer of sensitive personal information.

  • “User(s)” shall mean individuals that use the App to avail the Services.

     ​For purposes of this Privacy Policy, “Personal Information” means information that can be used to identify the User, including but not         limited to the individual’s full name, mobile number, email address, age, gender, physical address, photographs, videos, and X-rays.  ​

  • ​Personal Information Collected through the Website: We may collect your Personal Information when you contact us through (a) the contact us page on our Website. To use and access the Platform the Users of the Platform are required to provide Personal Information through the Platform.​

  • Personal Information Collected through the App: A User is required to share Personal Information with us to avail the Services more specifically during the diagnosis, consultation and treatment stages. The educational institutes including schools that share the Personal Information of the children/minors through the App are responsible to obtain necessary consent from the parents prior to sharing such information through the App.
     

  • Accuracy of information: The User undertakes that he shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Information shared with us whether of its own or any third party. ​

  • Use of Personal Information:  We use the Personal Information for the following purposes:

    • ​to provide you access to the App; 

    • to provide the Services and to assist the User to address any issues with the functioning of the App;

    • to demonstrate the functioning of the App;

    • sharing information  for educational purposes with Doctors, healthcare workers and respective POCs from educational institutes responsible for usage of the App;

    • to respond to queries raised by visitors to the Website;

    • to maintain and manage our App;

    • to manage our relationship with you and to comply with our legal or statutory obligations.

 

  • Cookies   

         We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns.

        What are Cookies?

        Cookies are alphanumeric files which are placed on to your device when you visit a website. It allows us to recognize your device and store some information                about your preferences or past actions, analyze trends, to learn about our user base, operate and improve our Offerings and  provide you with a better                          experience when you visit the Website.

  • Disclosures:  We will not sell, distribute or lease your Personal Information to third parties without your prior consent. Keeping this in mind, we may disclose your Personal Information in the following cases:​

    • Administrators​: We may provide access to User’s Personal information to any of our authorized administrators for addressing queries of Users in relation to the functioning of the App who shall be under confidentiality obligations.

    • Associate Partners: We may share User’s Personal Information to our business partners including but not limited to the hospitals, pathology laboratories, clinics, medical insurance companies, medical drugs companies, medicine shops, and other health experts that work with us to help you receive healthcare related services.

    • Service Providers: We may share your Personal Information with the service providers who work with us in connection with operating the Platform. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Policy.

    • Merger or Acquisition: We may transfer your Personal Information if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the Platform, to a third party. Any such third party or resultant entity that receives your Personal Information shall have the right to continue to use your Personal Information in line with the purposes set out herein. In the event of such a sale or transfer, we may notify you.

    • Legal and Regulatory Authorities: We may disclose your Personal Information in order to comply with our legal obligations/ court orders/ requests by Govt. authorities.

  • Data Retention

        We will retain User’s Personal Information as long as it is required to be retained for the purpose of provision of access to the Platform and performance of the            Services. We may retain and use User’s Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements

        Your Personal Information is stored on public cloud infrastructure. We have implemented security controls aligned with the best industry standards. Although            we provide appropriate firewalls and protections, we cannot warrant the security of Personal Information transmitted as these systems are not hack proof.                 Data pilferage due to unauthorized hacking, virus attacks, and technical issues is possible, and we will take necessary measures to mitigate such events.

  • Your Rights

        You have the right to access Personal Information right to have rectify or modify any such Personal Information, right to erase/delete your Personal                                Information, right to restrict from processing such Personal Information, right to object to use of Personal Information, withdraw consent at any time                           where we are relying on consent to process Personal Information. Users such as parents and/or children of respective schools/education institutes can exercise           the said  rights by requesting the authorities of the schools/ education institutes respectively.

       Our Platform may contain links to other websites/ Platforms of your interest. Please note that we do not have any control over such other websites/                               Platforms, and you will be accessing these websites/ Platforms at your own risk. Therefore, we cannot be responsible for the protection and privacy of any                     information which you provide whilst visiting such websites/Platforms and those are not governed by this Privacy Policy. You should exercise caution and look at        the Privacy  Policy applicable to such websites/Platforms.

  • Governing laws​

        This Privacy Policy shall in all respects be governed by and construed and enforced in accordance with the laws of India and the courts in Pune shall have                        an exclusive jurisdiction to adjudicate any subject matter under this Privacy Policy.

        Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which we may update from time to time. If we modify this Privacy                        Policy, we will make it available through the Platform and indicate the date of the latest revision. If such modifications materially alter your rights or obligations          hereunder, we will make reasonable efforts to notify you of the change via email or through our Platform.
